2021年4月9日英國內政部在一次更新指引. 這次進一步放寬港人持 BNO Visa 申請入籍英國. 允許主申請人及合資格的配偶和18 歳以下子女 (BNO Household Child) 可以分開入紙申請. Under Concession, 配偶和子女可分開申請 BNO Visa.

原本的申請要求, 是主申請人給所有家屬必須在48小時內同時遞交申請表格. 根據英國Home Office更新的指引 (Hong Kong BNO Visa Route Guidance), 准許BNO持有人的配偶或伴侶和未滿18歲的子女, 於特定情況 (Concession) 可分開申請 BNO Visa 簽證. 夫婦其中一人若希望先到英國, 另外一人可之後帶同子女赴英, 兩人可以分開申請簽證. 另外, BNO持有人獲發簽證後結識的新伴侶, 只要對方符合受養伴侶要求, 也可前往英國.

NOTE: 一位家長單獨首先移居英國安排事務, 另一位家長帶同孩子申請稍後去英國, 這在此特許權下或是允許的.

2022年4月6日: 英國內政部更新指引: 18歲以下孩子 (Household Child) 必須與父母一同申請. 除非父親或母親先單獨自行申請，而小朋友跟留港的父親或母親稍後才申請與已經在英國的父親或母親團聚. [BNO Visa Route Guidance]

A. 主申請人及家屬通常必須一同申請:

主申請人及家屬通常必須一同申請, 但是他們可以選擇分開進入英國. 家屬申請時必須填寫主申請人 (BNO Passport Holder) 的 Unique Application Number (UAN)參考編號或Global Web Form (GWF) 參考編號. 也需要同事在48小時內遞交申請表, 但是如果以下情況出現審批時也可作出讓步 (Concession):

BN(O) status holders and relevant family members must usually apply for the Hong Kong BN(O) route together, although they may choose to travel to the UK separately. In practice, this means that the main applicant who is a BN(O) status holder should apply first and receive their Unique Applicant Number (UAN) or Global Web Form (GWF) reference. Any dependants applying will need to quote this UAN or GWF in their applications. You should check whether dependants have applied within 48 hours of the main applicant unless the concession below applies.

A1. 與主申請人分開申請

主申請人 (BNO Status Holder) 及其配偶 (Spouse) 或伴侶 (Partner)和18歲以下的孩子 (Household Child) 可以與主申請人分開申請:

例如: 假如在主申請人及配偶在申請期間, 有新的小朋友出生, 小朋友也是符合BNO Visa資格的. 又或者BNO護照持有人獲批BNO Visa之後, 遇上新的伴侶, 這伴侶也符合BNO Visa資格. 伴侶只要符合 BNO Visa Route 相關的資格便可申請.

For example, this includes any children born whilst their parents are on the BN(O)route; you should grant them permission on the route in line with that of their parents’. Additionally, if a BN(O) status holder meets a new partner after a grant of permission on the BN(O) route, their partner would be able to come to the UK, providing they otherwise meet the requirements for a dependant partner on the Page 27 of 38 Published for Home Office staff on 08 April 2021 BNO Visa route.

A2. 夫婦分開申請:

有些申請人可能將申請分開了, 一名家長先進入英國安排相關事務, 而另一位家長之後才帶同小朋友 (BNO Household Child)過去英國團聚. 他們; 在此特許權下, 這也是允許分開申請的.

Note: 一位家長單獨首先移居英國安排事務, 另一位家長帶同孩子申請稍後去英國, 這在此特許權下或是允許的.

Some applicants may have staggered their applications so that one parent moves to the UK first to arrange affairs before the other parent and children join them; this would also be permissible under this concession.

A3. Household Member & Household Adult Dependent Relatives

需要注意: 其他家庭成員還是要跟住申請人一起申請的。如果主申請人已獲批BNO Visa, 那麼其他家庭成員 (Household Member or Household Adult Dependent Relatives) 就不可以之後才申請了.

A4. 同時申請永居身份

需要注意: 18歲以下小朋友 (BNO Household Child) 必須與 BNO Status 父母同時申請獲批永久居民身份 (Settlement Status) 及跟父母同時申請成為 British Citizen.

其他成年親屬 (Household Adult Dependent Relatives) 也需同時與主申請人 (BNO status holder) 或 BNO status holder 的配偶同時申請永久居民身份 (Settlement Status).

For a grant of settlement on the Hong Kong BN(O) route, a BN(O) household child must be being granted at the same time as their BN(O) status holder parent, and/or their other parent who is already settled or a British citizen. A BN(O) adult dependent relative must also be applying for settlement at the same time as the BN(O) status holder or the partner of a BN(O) status holder, or who is already settled or a British citizen.

A5. 必須一齊滿足5年的居住要求

允許不同時間入境, 但 BNO Status Holder (主申請人) 必須滿足5年的居住要求. UK 其他的 BNO Household Child, Household Dependent Relatives, 可以不同時間入境. 但大家必須滿足5年的居住要求才可申請成為永久居民. 假如 BNO Status Holder 未能滿足居住要求, 其他的 Dependents 便需要向英國移民局申請允許延期居留.

If the BN(O) status holder and their dependent BN(O) household child or BN(O) adult dependant relative travelled to the UK separately, the continuous residence requirement for settlement may mean that these dependants may have to apply for further permission to stay beyond 5 years if the BN(O) status holder has not yet fulfilled the continuous residence requirement.
